Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Saj Link, a sovereign encrypted communications platform operated by Sajdak Group Holdings ("we", "us", "our"). By creating an account or using Saj Link, you agree to be bound by these Terms. If you do not agree, do not use Saj Link.

2. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use Saj Link. By using the service, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms.

3. Account Registration

You must provide a valid phone number and, optionally, an email address to register. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at legal@sajlink.com if you believe your account has been compromised. You may not share your account or allow others to access it.

4. Acceptable Use

You agree not to use Saj Link to:

• Violate any applicable law or regulation.
• Send unsolicited messages (spam) or engage in bulk messaging.
• Harass, threaten, stalk, or abuse other users.
• Distribute malware, viruses, or any harmful code.
• Attempt to reverse-engineer, decompile, or circumvent our encryption systems.
• Impersonate another person or organisation.
• Engage in activities that violate the laws of the Kingdom of Bahrain, Australia, or the jurisdiction in which you reside.
• Transmit child sexual abuse material (CSAM) or any content that exploits minors.
• Use the service to coordinate acts of terrorism or violence.
• Attempt to gain unauthorised access to other accounts or our infrastructure.

We reserve the right to terminate accounts that violate these provisions and, where legally required, to report such activity to relevant authorities.

5. End-to-End Encryption and Privacy

Saj Link uses end-to-end encryption. We cannot access the content of your messages or calls. You acknowledge that this means we cannot recover encrypted content if you lose your device or cryptographic keys. We are not liable for data loss resulting from device loss, account deletion, or key loss.

6. Subscriptions and Billing

Saj Link offers free and paid subscription plans. Paid plans are billed through Paddle. All prices are displayed in USD unless stated otherwise. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled in accordance with Paddle's refund policy and applicable consumer law. We reserve the right to change pricing with 30 days' notice.

7. Account Termination

You may delete your account at any time via Settings → Account → Delete Account. We may suspend or terminate your account immediately if you violate these Terms, engage in illegal activity, or pose a risk to other users or our infrastructure. Upon termination, your data will be deleted per our Privacy Policy. Termination does not affect any accrued rights or liabilities.

8. Intellectual Property

All technology underlying Saj Link — including Saj Protocol V2, the Saj Codec, the on-device voice AI engine, and all associated patents and trade secrets — is owned by Sajdak Group Holdings. We grant you a limited, non-exclusive, non-transferable licence to use the Saj Link applications for personal or business communication purposes in accordance with these Terms.

Content you create and share via Saj Link (messages, voice recordings, files) remains yours. We do not claim any ownership over your content.

9. Disclaimers and Limitation of Liability

Saj Link is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure against all possible attacks.

To the maximum extent permitted by applicable law, Sajdak Group Holdings shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use Saj Link.

Our total cumulative liability to you for any claims arising from these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Bahrain. For users in Australia, the Australian Consumer Law applies to the extent required and is not excluded by these Terms.

Disputes will first be attempted to be resolved by direct negotiation. If unresolved within 30 days, disputes will be referred to binding arbitration under the rules of the Bahrain Chamber for Dispute Resolution (BCDR-AAA), conducted in English, seated in Manama, Bahrain. For consumer claims under AUD 10,000 in Australia, you may instead use the relevant state consumer tribunal.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification and email at least 14 days before changes take effect. Continued use of Saj Link after the effective date constitutes acceptance of the updated Terms.

12. Miscellaneous

• Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding Saj Link.
• Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
• No waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger or acquisition.
